Welcome to JMK Shutters Inc. (“JMK Shutters,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of jmkshutters.com (the “Site”) and our services. By using our Site, requesting a consultation, purchasing our products, or engaging our services, you agree to these Terms. If you do not agree, please do not use our Site or services.

1. About JMK Shutters

JMK Shutters Inc. is a California-licensed contractor (CSLB License #976634) specializing in the design, sale, and professional installation of shutters, shades, blinds, drapes, and related window covering products. We have served the Bay Area since 1995.

2. Services We Provide

Our services include:

Free in-home consultations
Custom design and product recommendations
Sale of shutters, shades, blinds, and drapes from manufacturers including Hunter Douglas, Alta, JC, and others
Professional measurement and installation
Repairs and warranty service
Maintenance services on previously installed products

Service area: Santa Clara County, San Francisco County, Contra Costa County, Alameda County, and surrounding Bay Area communities. Specific service availability may vary by location.

3. Estimates and Quotes

All estimates and quotes are:

Provided free of charge after an in-home consultation
Valid for 30 days from the date of issue unless otherwise noted
Subject to verification of measurements at time of installation
Not binding until accepted in writing by both parties

Pricing is based on the products selected, window count, installation complexity, and any required modifications.

4. Orders, Deposits, and Payment

Deposits: A deposit is typically required before custom products are ordered from the manufacturer. Deposit amounts and payment terms will be specified in your written quote or order confirmation.

Final Payment: The remaining balance is due at the time of installation unless other written arrangements are made.

Accepted Payment Methods: Cash, check, and major credit cards. Specific accepted methods may be confirmed at the time of order.

Custom Orders: Most products we sell are custom-manufactured to your specifications. Once a custom order is placed with the manufacturer, it generally cannot be canceled or returned.

5. Cancellation and Refunds

Before Order Placement: You may cancel your order at any time before it has been placed with the manufacturer with a full refund of any deposits paid.

After Order Placement: Once a custom order has been placed with the manufacturer, cancellations are generally not permitted because the product has been built specifically for you.

Defects or Damage: If a product arrives defective or damaged, we will work with the manufacturer to repair or replace it under warranty.

Right of Cancellation: California law provides specific cancellation rights for home solicitation contracts. You will receive written notice of these rights with your order paperwork.

6. Installation and Service

Scheduling: Installation appointments are scheduled based on product availability and our installer schedule. We will notify you when your order has arrived and we are ready to schedule installation.

Customer Responsibilities: You agree to provide reasonable access to the installation areas, ensure the work areas are reasonably clear, and have an authorized adult present during installation.

Site Conditions: If unforeseen site conditions are encountered (such as structural issues or hidden electrical/plumbing), we may need to reschedule or adjust the scope of work. Additional charges may apply for work outside the original scope.

7. Warranties

Manufacturer Warranty: All products carry the manufacturer’s warranty as published by that manufacturer. We will provide warranty information at the time of purchase.

Workmanship Warranty: We stand behind our installation work. If you experience an issue with our installation within a reasonable period, contact us and we will address it.

Limitations: Warranties do not cover damage caused by misuse, abuse, accidents, normal wear and tear, or modifications made by parties other than JMK Shutters.

8. SMS / Text Message Terms

By providing your phone number to JMK Shutters and opting in to receive text messages, you agree to the following:

You consent to receive text messages from JMK Shutters Inc. regarding appointment confirmations, service updates, follow-ups, promotional offers, and review requests
Message frequency varies based on your interactions with us
Message and data rates may apply per your mobile carrier’s plan
You can reply STOP at any time to opt out of all future text messages
You can reply HELP for help and our contact information
Consent to receive text messages is not a condition of purchase
You confirm that you are the owner or authorized user of the phone number provided and that you are at least 18 years old
We will not share your phone number or SMS opt-in data with third parties for their marketing purposes

Carriers (including but not limited to AT&T, Verizon, T-Mobile) are not liable for delayed or undelivered messages. JMK Shutters Inc is not responsible for any delays, failures, or issues caused by the wireless carrier.

Voice Communications and AI Calling

By providing your phone number to JMK Shutters Inc. through any channel including our website, contact form, chat widget, lead capture forms on third-party platforms such as Google Ads or Yelp, or in person, you expressly consent to receive phone calls from JMK Shutters Inc. at the number provided. You consent to these calls being made using automated technology, including but not limited to autodialers, prerecorded messages, and AI-generated voice agents.

These calls may include appointment scheduling, consultation follow-up, service updates, customer care, and marketing communications you have specifically consented to receive. Consent to receive AI or automated voice calls is not a condition of purchasing any goods or services from JMK Shutters Inc.

Calls will only be made between 8:00 AM and 9:00 PM in your local time zone, in compliance with federal and state law. Calls may be recorded for quality assurance and training purposes.

Our total liability for any claim relating to our products or services is limited to the amount you paid for the specific product or service giving rise to the claim.

This limitation does not apply to liability for fraud, gross negligence, or any liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless JMK Shutters Inc. from any claims, damages, or expenses arising from your violation of these Terms or your misuse of our Site or services.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any disputes arising under these Terms will be resolved in the state or federal courts located in Santa Clara County, California, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. The “Last Updated” date at the top reflects the most recent version. Continued use of our Site or services after changes are posted constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
